One of the happier areas that family law attorneys practice is adoption. When an adoption is finalized, the adopted child has all the same rights and privileges in the adoptive family that a biological child does. The law firm of Edwards & Associates handles a wide range of domestic matters involving all aspects of family law. Our clients can benefit from our experience and dedication to the adoption process. Many people are not aware that the adoption code in Georgia is very stringent and rigid. You need competent counsel to ensure that deadlines are not missed that may result in the adoption being contested. Currently, Edwards & Associates is only handling stepfather adoptions (contested or uncontested).
Relative Adoptions
Stepparent Adoptions:
Step-parent adoptions can take place when a child's non-custodial, biological parent is deceased or has little to no relationship with the child. The step-parent who lives with the child and has established a parental bond may wish to adopt. These cases require either proof that the absent parent is deceased or that his or her parental rights should be terminated.
Extended Family and Grandparent Adoptions:
There are several situations when grandparents or other family members may seek to adopt a child. Grandparents frequently adopt their grandchildren when a child’s parents have both died or are in prison. Or, when one custodial parent dies or is incapacitated and he or she does not want the other birth parent to have custody; in this case the custodial parent may seek a contested adoption. On occasion, a grandparent will contest an adoption or seek to adopt when a birth mother is planning to place her child—their grandchild—for independent adoption by a third party. Finally, when children have been permanently removed from their parents' care by the Georgia Division of Family and Children Services (DFCS) due to abuse or neglect, grandparents or extended family members may choose to adopt the children.
